These Terms of Service ("Terms") are a binding agreement between you ("you" or "User") and IRL LLC, a New Hampshire limited liability company ("IRL Bonded," "Company," "we," "us," or "our"), governing your access to and use of www.irlbonded.com, our iOS application, and our related bonded-connection live streaming services (collectively, the "Service").
BY CREATING AN ACCOUNT, DOWNLOADING THE APP, OR OTHERWISE ACCESSING OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.
1. Eligibility
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use the Service. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements.
2. The Service
IRL Bonded provides technology that bonds multiple cellular and/or network connections into a single stream, performs real-time packet loss detection and recovery, and enables multistreaming to third-party platforms (including but not limited to Twitch, Kick, YouTube, X/Twitter, and Facebook). The Service may be used with our cloud relay infrastructure, a self-hosted receiver (e.g., your own iPhone, iPad, or Apple TV), or a private cloud instance, as selected by you.
We may modify, suspend, or discontinue any part of the Service at any time, with or without notice, including features, pricing structures, or platform integrations.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate and complete information when creating an account and to keep it up to date. Notify us immediately at support@irlbonded.com if you suspect unauthorized use of your account.
4. Billing, Credits, and Payment
- Pay-As-You-Go Pricing: The Service is billed on a usage basis (e.g., per-GB data transfer, per-hour cloud/private cloud server usage, and/or monthly self-hosted server fees), as described on our Pricing page, which may be updated from time to time.
- Payment Processing: All payments are processed through Stripe. By providing payment information, you authorize us (via Stripe) to charge the applicable fees to your chosen payment method. We do not store your full payment card details.
- Free Credit / Promotional Credit: Promotional credits (such as sign-up credit) are subject to expiration, usage limits, and other restrictions we may specify at the time they are granted, and have no cash value.
- No Refunds: Except as required by law or as otherwise expressly stated, fees and consumed credits are non-refundable, including for unused portions of self-hosted server subscription periods.
- Taxes: You are responsible for any applicable taxes, and fees may be adjusted to account for taxes we are required to collect.
- Price Changes: We may change our pricing at any time. Changes will apply prospectively and will be posted on our Pricing page.
- Non-Payment: We may suspend or terminate your access to the Service for non-payment or failed billing.
5. Acceptable Use
You agree not to use the Service to:
- Stream, transmit, or distribute content that is illegal, infringing, defamatory, obscene, harassing, threatening, or that violates the rights of any third party;
- Violate the terms of service of any third-party platform you connect to or stream on (e.g., Twitch, Kick, YouTube, X/Twitter, Facebook);
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service, our servers, or other users' accounts or devices;
- Reverse engineer, decompile, or attempt to extract the source code of our software, except where permitted by applicable law;
- Use the Service to transmit malware or engage in any activity that could damage, disable, or impair our infrastructure or that of our cloud or platform partners;
- Resell, sublicense, or commercially exploit access to the Service without our prior written consent;
- Circumvent usage-based billing or misrepresent your usage of the Service.
We reserve the right to investigate and take appropriate action, including suspending or terminating accounts, for violations of this section.
6. Third-Party Platforms and Content
The Service enables you to connect to third-party streaming platforms and services. We are not responsible for, and do not control, the content, policies, availability, or practices of those third-party platforms. Your use of any third-party platform is governed by that platform's own terms and policies. You are solely responsible for the content you stream and for complying with the terms of any platform you connect to through the Service.
7. Your Content
You retain all ownership rights in the video, audio, and other content you stream through the Service ("Your Content"). By using the Service, you grant us a limited, non-exclusive, worldwide license to transmit, relay, route, buffer, and process Your Content solely as necessary to provide the Service (e.g., bonding, packet recovery, and delivery to your selected destinations). We do not claim ownership over Your Content and do not use it for any purpose other than operating the Service, except as described in our Privacy Policy.
You represent that you have all necessary rights to stream Your Content and that it does not infringe or violate the rights of any third party.
8. Intellectual Property
The Service, including its software, protocols (such as our Smart Recovery data protocol), branding, and website content, is owned by IRL Bonded and its licensors and is protected by intellectual property laws. Except for the limited right to use the Service as permitted by these Terms, no rights are granted to you in our intellectual property.
9. Beta / Alpha Features
Certain features of the Service may be offered as "Alpha," "Beta," or otherwise experimental. Such features are provided "as is," may be unstable, may change or be discontinued at any time without notice, and are used at your own risk.
10. Service Availability
While we strive to provide reliable bonded connectivity, the Service depends on factors outside our control, including cellular network availability, third-party platform uptime, and your device's hardware and connectivity. We do not guarantee uninterrupted, error-free, or drop-free streaming.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL PREVENT ALL STREAM INTERRUPTIONS OR DATA LOSS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IRL BONDED AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING WITHOUT LIMITATION STREAM INTERRUPTIONS, DROPPED CONNECTIONS, OR LOST STREAMING OPPORTUNITIES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless IRL Bonded and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) Your Content; (b) your violation of these Terms; (c) your violation of any third-party platform's terms; or (d) your violation of any applicable law or the rights of a third party.
14. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without cause or notice, including for violation of these Terms, non-payment, or suspected fraudulent or abusive activity. Upon termination, your right to use the Service will immediately cease, and any unused credits may be forfeited except where prohibited by applicable law.
15. Modifications to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last Updated" date. Material changes will be communicated through the Service or by email where appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
16. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of New Hampshire, without regard to its conflict of law principles. You agree that any dispute arising out of or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in New Hampshire, and you consent to the personal jurisdiction of such courts.
17. Apple App Store Terms
Because the Service is currently distributed as an iOS application, the following additional terms apply where relevant:
- These Terms are between you and IRL Bonded only, and not with Apple Inc. ("Apple"). Apple is not responsible for the Service or its content.
- Your license to use the app is limited to a non-transferable license to use the app on an Apple-branded device that you own or control, as permitted by the Apple Media Services Terms and Conditions.
- Apple has no obligation to furnish any maintenance or support services for the app.
- Apple is not responsible for any product warranties, whether express or implied by law, except where required by law, in which case the warranty obligation belongs solely to IRL Bonded.
- Apple is not responsible for addressing any claims by you or a third party relating to the app.
- Apple is a third-party beneficiary of these Terms and, upon your acceptance, will have the right to enforce these Terms against you.
18. Miscellaneous
- Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and IRL Bonded regarding the Service.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Force Majeure: We are not liable for delays or failures in performance resulting from causes beyond our reasonable control, including network outages, third-party platform outages, or acts of God.
